1. Fees
Unless otherwise agreed in writing, all fees are charged according to our standard rates.
2. Usage Rights (Image Rights)
Any use of an image — for any purpose — will automatically result in an invoice from the agency for the transfer of reproduction rights, regardless of the time elapsed between the date of the shoot and the date of publication.
Reproduction rights are granted for all uses except the following: posters, outdoor billboards, POS material, packaging, large-scale mailing campaigns, and TV/Cinema.
The fee for reproduction rights depends on the nature and reach of the publicity campaign, but will never be lower than the rates listed in our official pricing.
Unless otherwise agreed and specified on the invoice, reproduction rights are granted for a period of one year within Belgium. Any later or additional use requires a new agreement and separate invoice.
The client must notify the agency in advance and in writing of any new or additional use of the images beyond what is specified in the invoice.
In cases where multiple clients are involved in the same shoot, the applicable fee will be calculated separately for each client from the first hour of use.
3. Client Feedback
Any comments or disputes concerning a model’s performance must be raised with the agency during the assignment itself. After the assignment has ended, no complaints will be accepted.
4. Cancellations
Weather-dependent bookings must be declared as such at the time of the request.
These bookings can be cancelled without charge until 17:00 on the day before the shoot.
Cancellations made on the same day will be charged at 50% of the agreed fee.
5. Exclusivity
Booking a model does not automatically grant exclusivity. Exclusivity must be agreed upon in advance in a written contract between the agency and the client.
6. Options
Any booking option that is not confirmed at least 48 hours before the assignment will be considered void.
7. Performance Calculation
A model’s performance time begins at the agreed appointment/start time provided by the client and ends when the client declares the shoot finished.
Any overtime of more than 30 minutes will be charged as an additional full hour.
8. International Assignments
For assignments outside Belgium, models are paid on the basis of a minimum of 4 hours. Travel time and accommodation costs (if applicable) will be charged according to the agreed contractual rates.
General Conditions
1. Acceptance of Terms
By placing an order, the client automatically accepts these General Terms & Conditions and waives their own.
2. Suspension of Obligations
If the client fails to fulfil their obligations under an order, the agency is automatically released from its own obligations related to that order.
3. Employment Relationship
Models are not employees of either the client or the agency. They perform assignments independently, without subordination.
The agency is not liable if an assignment cannot take place on the agreed date due to circumstances beyond its control.
4. Payments
All invoices are payable within 30 days from the end of the month in which the assignment took place.
Late payments are subject to an automatic interest charge of 1.5% per month, calculated from the date of the invoice, without prior notice of default.
5. Place of Payment
Payments are only valid if made directly to People Choice. Clients are not authorised to pay models directly.
6. Jurisdiction
In the event of a dispute, only the courts of Ghent (Belgium) shall have jurisdiction.
